breach of contract with the national guard

I've got a problem i need someone's help with. I re-enlisted back in 2007 with the national guard for what my contract says is 20,000. They said i had a bad contract and they could only pay me 15. After a year i finially got paid the 15 but they refused the other 5. I called the IG office and they said i could get out of my contract but i'd have to pay a pro-rated ammount back all at once. Is this right?

State Law runs this one, I'm a reservist and the bonus I recieved was what I got, but I had a payment plan (50% 1st year, 10% each year after) that had to be submitted with my re-up paperwork.

I think that the contract was probably submitted with a prior or incorrect bonus number and that you never really qualified for on the contract.

2 choices here and remember that I say this with the utmost respect:

1. If WV isn't asking for ALL the money back, get out and pay the pro-rated.:suspicious:
or
2. Stay in and take all the money they will give you!:cool:
 
Yeah they told me it would be about 10,000 i would have to pay back, but the IG told me that it would be an all at once thing. I don't have that kinda money to pay back.

Ouch, that hurts, I'm on my way to my last stripe and will stick it out for the next 3 years of my contract.

Hope you find some "happy medium" with your service requirement.:cool:
